    This rewards programme is controlled, managed and administered by Performance Bonus Ltd and its agents and any correspondence concerning this promotion should be directed to Performance Bonus Ltd, 2 St Mary St, Chepstow, Monmouthshire, NP16 5EU.
    The vehicle tracking incentive programme is designed to reward sales of qualifying vehicle tracking contracts and other reward criteria as communicated from time to time by Performance Bonus Ltd.
    Participants in this incentive programme warrant that they are duly authorised and empowered to execute, deliver and perform within it and that such action does not conflict with or violate any provision of law, regulation, policy, contract, deed of trust or other instrument to which they are a party or by which they are bound.
    This Agreement shall not be deemed to create any partnership, joint venture, or agency relationship between Performance Bonus Ltd and participants in this incentive programme. Each Party shall act hereunder as an independent contractor.
    Rewards are awarded only in respect of qualifying sales as specified by Performance Bonus. Performance Bonus shall be entitled at any time to alter the reward criteria which must be met to enable any event to count as a reward qualifying achievement. The decision as to whether any reward is due rests with Performance Bonus and both parties accept that the decision of Performance Bonus Ltd will be final.
    Any rewards account, which remains inactive (ie there are no activity on the account for a period of 6 months) will be deemed by Performance Bonus to be no longer required by the account holder. The account will therefore be closed and any rewards entitlement will be forfeited.
    Performance Bonus reserves the right to amend, suspend, withdraw or terminate this rewards programme at any time for any reason and without notice or liability.
    All reward payments are contingent upon Performance Bonus receiving cleared commission funds from our supplier (Quartix). In the event of non receipt of commission or deductions therefrom for whatever reason this reward account shall be immediately terminated and no incentive rewards paid.
    All trademarks are recognised and no endorsements are intended or implied.
    Rewards will be credited to the account holder’s prepaid ‘non cash’ BONUS Mastercard account, such card being subject to the card issuer’s Terms and Conditions as supplied with the card and amended from time to time. A copy of these Terms and Conditions can be downloaded at any time from our website bonusme.uk.
    Performance Bonus may withdraw use of the Card at any time, without notice.
    Your personal data (as defined in the Data Protection Act 1998) (“Personal Data”) will be obtained and processed by the Card Issuer/Processor in connection with your use of the Card. This may include data transfers outside of the EU. Your Personal Data will be obtained and processed by Performance Bonus in connection with your use of the Card and participation in this programme.
    You remain responsible for assessing and accounting to the relevant taxation authority for all and any taxes, in particular but not exclusively, income tax or Value Added Tax (VAT) which may become due and payable as a result of any trading activity. Should your income through this and/or other programmes and/or other personal trading activities exceed your annual personal gross trading allowance it is your responsibility to inform HMRC and register as self employed within the prescribed timescales. You should then go on to complete a self assessment income tax return (detailing all your earnings) if you do not already do so.
    You undertake and agree with Performance Bonus to pay Performance Bonus an amount equal to any tax including any costs, interest, charges or penalties which Performance Bonus is required to account to HM Revenue and Customs which arises as a result of or by reference to the provision of your Card or involvement in this incentive scheme.
    Performance Bonus reserves the right not to honour or proceed with any application or rewards claim where, in the opinion of the company, the rewards entitlement is stolen or obtained by any fraudulent means.
    Performance Bonus will not be liable under any circumstances to you for: loss of profit, business, goodwill, anticipated savings, goods, contract, use or data; losses arising from the acts or omissions of an Performance Bonus Ltd or Quartix; or for any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses. This incentive programme is only open to persons aged 18 years or older.
    We would like to draw your attention to the PREVENTION OF CORRUPTION ACTS 1906 & 1916. Employees should advise their employers or other contracted party before participating in any incentive scheme which might be deemed not in the best interests of their employers or other contracted party. It is not the intention of Performance Bonus and its Agents to induce any party to act against the interest of their employers or other contracted parties and Performance Bonus Ltd and its agents will accept no liability for such.
